Register of Damage for Ukraine: сomparison with the “eVidnovlennia” Programme

The eVidnovlennia (eRecovery) programme and the international Register of Damage for Ukraine (RD4U) are mechanisms that differ in their nature and purpose and are applied in connection with damage caused by the war. In order to enable applications to both mechanisms, the digital platform Diia is used, which leads to confusion. However, at present, an application to RD4U can be submitted through the Diia portal, whereas an application for compensation under eVidnovlennia can be submitted through the Diia mobile application.


Legal basis

eVidnovlennia is a national programme implemented in accordance with the legislation of Ukraine, in particular the Law of Ukraine “On Compensation for Damage and Destruction of Immovable Property” and Resolution of the Cabinet of Ministers of Ukraine No. 381. The purpose of the programme is to provide state support to owners of damaged or destroyed housing.

RD4U was established on the basis of Resolution CM/Res(2023)3 of the Council of Europe and operates within the framework of an Enlarged Partial Agreement.

RD4U receives and registers claims concerning various types of damage, including loss of access to or control over property, internal displacement, damage to life and health, and other categories provided for by the Statute and Rules of the Register. RD4U does not provide payments at the time of submission of a claim but creates a database for a future compensation mechanism.


Sources of funding

The eVidnovlennia programme is implemented through state and donor resources.

The future compensation mechanism associated with RD4U provides for other potential sources of funding, which will be determined by separate international decisions.


Interaction of the mechanisms

Submitting an application within the framework of eVidnovlennia does not restrict a person’s right to submit a claim to RD4U and is aimed at addressing housing-related needs within the national procedure.

Documents generated within the framework of eVidnovlennia may be used as part of the evidentiary basis when submitting a claim to RD4U. At the same time, RD4U ensures the registration of the full scope of declared losses for possible future consideration within an international compensation mechanism.

Taking into account their different legal nature and functional purpose, these mechanisms may be applied in parallel.
