eRestoration Program Compensation Support

Serhii is currently living in the Poltava region due to forced displacement. His home in the village of Chkalove, Kharkiv region, was damaged. He sought compensation for repairs but needed legal guidance on the steps to take, how to submit an application, document the damage, and arrange an inspection by the commission. 

He turned to a lawyer from the NGO Institute for Analysis and Advocacy, who reviewed his property documents. It was found that although Serhii is the rightful owner of the house under a 2007 gift agreement, he did not have an extract from the State Register of Property Rights to Real Estate (SRPR). To access the register, the lawyer helped Serhii create a qualified electronic signature (QES) and register on the Diia portal. Together, they submitted the notification and application for compensation under the eRestoration program. 

One challenge was that Serhii could not be present during the home inspection. To obtain a damage assessment report, the lawyer submitted a request and a set of documents to the village’s regional territorial community. Serhii received a verbal refusal to accept the documents, but the lawyer persisted and drafted a complaint addressed to the head of the community, arguing the illegality of the commission’s actions. She pointed out a violation of Serhii’s rights, as he was not given a proper opportunity to apply for protection and compensation. 

These efforts paid off: the commission representatives contacted Serhii and arranged a date to inspect his damaged home. The results of the inspection were entered into the Diia system, and Serhii eventually received compensation that fully matched the extent of the damage.
