Obtaining ownership rights to a house in area of hostilities
Dmytro's family fled Kostiantynivka in Donetsk Oblast to Dnipro due to the hostilities. Even before relocating, they had been caring for Dmytro's grandmother and brought her with them. She had bequeathed her house to Dmytro, but passed away some time later. By then, the house had become located in area of hostilities and had been destroyed. This raised the question of how to complete the inheritance procedure under such circumstances.
Dmytro could apply for state compensation for the destroyed house under the eVidnovlennia (eRecovery) programme only after registering his ownership rights. The family also intended to submit a claim to the Register of Damage for Ukraine (RD4U) for compensation.
Dmytro was the family's only source of income. His wife was unable to work because she cared for their child, who has a severe form of allergy. As a result, the costs of notarial services and preparing the necessary documents were unaffordable for the family. In addition, completing the inheritance procedure required updating the technical documentation for the house, which also involved additional expenses.
Dmytro needed both legal assistance and financial support. Without such assistance, completing the inheritance procedure would have been almost impossible.
He turned to the Caritas Mariupol Charitable Foundation for assistance. A lawyer supported the case at every stage, while the Foundation, within the framework of the project, covered the costs of the notary's services and the preparation of the required documents.
As a result, Dmytro successfully completed the inheritance procedure and obtained all the documents confirming his ownership rights to the house.
Afterwards, the lawyer assisted him in submitting applications for state compensation under the eVidnovlennia (eRecovery) programme and to the Register of Damage for Ukraine (RD4U) for forced displacement (Category A1.1) and for the destruction of the house (Category A3.1).
As a result, Dmytro's family gained the opportunity to receive compensation and financial support to rebuild their lives.
