Tamara* planned to file a report on the damage to her apartment in Avdiivka, Donetsk Oblast. However, when she tried to do so, she found out that information about her ownership of the apartment was not available in the State Register of Real Property Rights (SRPR). Because of this, she could not file a report on the damaged or destroyed property or initiate other legal procedures.
She turned to a lawyer from the STEP NGO for help. The lawyer explained the procedure in such a situation, described in detail the procedure for entering data into the register and the list of documents required for this.
During the consultation, it became known that Tamara is the owner of an apartment located in Avdiivka, which is currently under occupation. Her property right was registered in the 90s with the Bureau of Technical Inventory (BTI), and therefore the data on the apartment was not entered into the SRRP.
When Tamara applied to the registrar, she was denied entry of information about the apartment into the register, as it was impossible to obtain confirmation of ownership due to the situation with the BTI.
The lawyer helped to collect the necessary evidence and prepare a statement of claim to the court to recognize the ownership of the apartment. The court considered the case and fully satisfied the claim - the ownership of the apartment was officially recognized.
Now Tamara can enter the information about the apartment into the register of real rights to real estate. This will allow her to exercise all the rights of a real estate owner, including filing a report of damage or destruction of property.
The free legal aid in Zaporizhzhia region was made possible thanks to the cooperation of the NGO STEP with the Danish Refugee Council and funding from the European Union.
