What liability is provided for the owner of an animal if the latter causes harm to another person?

1. Civil liability:

  • The owner of the animal is obliged to compensate:
  • Material damage (for example, the cost of treatment or repair of damaged property).
  • Non-pecuniary damage (in the case of moral suffering caused to the injured person).
  • The obligation to compensate arises only if the damage is caused by the owner's fault, for example, due to non-compliance with the rules of keeping or walking the animal.

2. Administrative liability:

  • In case of violation of the rules of walking or keeping that caused damage, the owner may be held administratively liable:
  • Penalty: UAH 1,700 to 3,400 (100 to 200 tax-free minimum incomes).
  • Confiscation of the animal is possible.

3. Criminal liability:

  • In case of causing serious harm to the health of another person:
  • Community service: for a period of 150 to 240 hours.
  • Correctional labour: up to 2 years.
  • Restraint or imprisonment: up to 2 years.
  • If the damage caused the victim's death:
  • Restraint or imprisonment: for a term of 3 to 5 years.
