The basis and procedure for deducting alimony for a child at the initiative of the recipient

In Ukraine, the recipient of alimony has the right to initiate the deduction of alimony directly from the payer's income.

Procedure:

1. Obtaining an enforcement order:

  • After the court makes a decision on alimony, the recipient receives an enforcement order.

2. Submitting the application:

  • The recipient submits the application along with the enforcement order directly to the place of employment, pension, scholarship payments, or any other income of the alimony payer.

3. Deductions of alimony:

  • Based on the submitted documents, the relevant institution carries out the deduction of alimony in the amount specified in the enforcement order.
  • Deductions must be made no later than three days from the established date for the payment of wages, pensions, or scholarships.

4. Transfer of funds:

  • The deducted amounts are transferred to the recipient of the alimony at the address provided or to the specified account in the application.

Special considerations:

  • This mechanism allows the recipient to initiate the deduction directly, bypassing the enforcement service.
  • Deductions can still be made even if the total deductions exceed half of the payer's income or if alimony is already being collected for another child.
