List of individuals who have right for the temporary protection in the EU

1. Citizens of Ukraine who were forced to leave Ukraine on or after 24 February 2022 due to hostilities.

2. Stateless persons and third country nationals who:

  • enjoyed international protection or equivalent national protection in Ukraine before 24 February 2022.

3. Family members of persons referred to in paragraphs 1 and 2, in particular

  • spouse (including unregistered marital relationships, if recognised by the relevant EU state);
  • minor unmarried children or children of the spouse (born in marriage, out of wedlock or adopted);
  • close relatives who were living together as a family at the outbreak of war and were dependent on persons from points 1 or 2.

4. Third-country nationals who:

  • have legally resided in Ukraine until 24 February 2022 on the basis of a valid permanent residence permit issued in accordance with the legislation of Ukraine;
  • cannot return in safe and sustainable conditions to their country or region of origin.

5. Additional categories depending on the decision of each EU country:

  • Ukrainian citizens who travelled to the EU shortly before 24 February to escape a possible war, or were on holiday or business trip;
  • stateless persons or third-country nationals who legally resided in Ukraine before 24 February 2022 but did not have a permanent residence permit and cannot return to their country of origin in safe conditions.
