What is the amount of severance pay in case of termination of employment under the simplified regulatory regime?

The amount of severance pay depends on the grounds for termination of employment:

1) Grounds provided for in the Labour Code:

  • Reduction of staff, liquidation of the enterprise and other grounds: the employee is paid severance pay in the amount of not less than the average monthly salary.
  • Conscription or enlistment in the military: severance pay is equal to two minimum wages.
  • Violation of labour laws by the employer: severance pay is determined by a collective bargaining agreement, but not less than three months' average salary.
  • Reinstatement of an employee who previously performed the same job: severance pay is not less than six months' average earnings.

2) Grounds not provided for in the Labour Code:

Termination of an employment contract at the initiative of the employer for other reasons: the employee is provided with a compensation payment in the amount and manner specified in the employment contract, but not less:

  • Half of the minimum wage - if the sum of the employee's periods of work for this employer is no more than 30 days.
  • One minimum wage - if the sum of the employee's periods of work with this employer is more than 30 days.
  • Three minimum wages - if the sum of the employee's periods of employment with this employer is more than one year.
  • Five minimum wages - if the sum of the periods of work for this employer is more than two years.
