What is the liability for evading a conscription notice or failure to come to a military office upon requirement in the notice?

Evading a notice or failing to appear at the Territorial Centre of Recruitment and Social Support (TCR & SS) upon receipt of a notice may result in administrative or criminal liability, depending on the circumstances.

Administrative liability:

  • Violation of the rules of military registration: Refusal to receive a call-up or failure to appear upon a call-up to clarify credentials or undergo a medical examination may result in a fine of UAH 17,000 to 25,500.

Criminal liability:

  • Evasion of conscription during mobilisation: If a person, having received a call-up notice with a mobilisation order, intentionally fails to report to the Territorial Centre of Recruitment and Social Support, this may be qualified as draft evasion. According to Article 336 of the Criminal Code of Ukraine, such actions are punishable by imprisonment for a term of three to five years.

Important:

  • Liability is incurred only if the summons is duly served. If a person refuses to receive a summons, authorised persons may draw up an act of refusal in the presence of witnesses, which is considered to be proper service.
