What are the penalties for committing sex-based violence?

In Ukraine, administrative liability is established for committing sex-based violence. In December 2024, the penalties for such offenses were strengthened. A specific article was added to the Code of Ukraine on Administrative Offenses (Article 173-6 "Committing Sex-Based Violence"), and the sanctions for committing sex-based violence were increased. 

The legislation provides the following types of penalties for committing sex-based violence: 

Fines: 

  • From 1,700 UAH to 3,400 UAH (equivalent to 100–200 tax-free minimum incomes of citizens1
  • From 3,400 UAH to 5,100 UAH (200–300 tax-free minimums) in case of a repeat offense within one year. 

Community service: 

  • 20 to 40 hours for a first offense 
  • 40 to 60 hours for a repeated offense within one year. 

Correctional labour: 

  • Up to 1 month, with 20% of earnings withheld 
  • 1 to 2 months for a repeated offense. 

Administrative arrest: 

  • Up to 10 days, applied in cases of repeated offenses within one year.
