How to refuse from the acceptance of inheritance under martial law?

The sequence of steps for disclaiming inheritance under martial law is the same as under normal conditions.

The heir can disclaim inheritance within the deadline for acceptance of inheritance. In this case, heir must apply in the procedure defined for submitting an application for acceptance of inheritance, in person or by sending an application by mail (in the latter case, the signature on the application shall be notarised). If the inheritance case has already been opened by a certain notary or an official of a local self-government body, such an application is submitted to them.

The legislation does not establish any requirements for the application to disclaim inheritance.

However, such an application should mention:

1) full name of the notary or the name of the notary office where the applicant is applying to;

2) address of the notary or notary office;

3) the applicant’s full name, their passport details, residential address and registration address, and contact details;

4) information about the death of the testator (full name, date of death, last known place of residence);

5) your wish to disclaim inheritance;

6) declaration of awareness of the contents of Articles 1269, 1270, 1268, 1273, 225, 229-231, 233 of the Civil Code of Ukraine;

7) information about other heirs (full names, passport details, residential address, registration address, contact details).

In addition, the following must be added to the application:

1) a copy of an identity document;

2) a copy of the testator's death certificate;

3) a document confirming the last place of residence of the testator.

An individual, whose capacity is limited, may disclaim inheritance with the consent of the guardian and the guardianship and curatorship body.

Minor aged 14 to 18 may disclaim inheritance with the consent of their parents (adoptive parents), guardian, or guardianship and trusteeship body.

Parents (adoptive parents) or a guardian may disclaim inheritance belonging to a minor or incapacitated person, only with the permission of the guardianship and curatorship body.

Please note! The inheritance disclaimer can be revoked within the deadline for acceptance of inheritance by giving the relevant notice.
