Liability for an accidentally running down a dog. What is the intended liability?

1. On the roadway:

  • If a dog is hit by a car on a roadway where it is not supposed to be, the driver's liability is excluded, provided that:
  • The driver followed the traffic rules.
  • Did not violate the speed limit or other safety requirements.

2. On the sidewalk or in the yard of a residential building:

  • If the dog is run over in a place where it could have been without violating the established rules (e.g. on a sidewalk or in a yard):
  • The driver of the car is administratively liable.
  • Penalty: UAH 850 in accordance with Article 140 of the Code of Ukraine on Administrative Offenses.

Additional aspects:

1. Compensation for damages is possible:

  • The dog owner can claim reimbursement for the cost of treatment or compensation for the loss of the animal if it is proven that the driver was negligent or violated traffic rules.

2. Responsibilities of the dog owner:

  • Ensure that the dog is walked on a leash or in places where it is allowed.
