Legal consequences of the appearance of parents who have gone missing under special circumstances and whose child has been placed under guardianship.

Share

1. Termination of the search

  • Once the location of a person missing under special circumstances is established, the search is officially terminated and the relevant status is lost.

2. Changing the status of a child

  • A child loses the status of a child deprived of parental care if the found parents are officially recognised as missing under special circumstances.

3. Termination of guardianship

  • Guardianship over a child is terminated if the child is returned to the parents or one of them.
  • The child is returned on the basis of a decision of the guardianship and custody authority or court (if necessary).

If there are doubts about the ability of the parents to fulfil their duties, the guardianship and custody authorities may conduct an additional check before the child is returned.
