Rights of relatives and family members of persons who have disappeared under special circumstances

Close relatives and family members of a person who went missing under special circumstances have the right to:

1. Receive reliable information:

  • On the whereabouts of the missing person or the circumstances of his/her death.
  • The place of burial (if known).

2. To file an application for search:

  • Submit an application to the Ministry of Internal Affairs to search for the missing person.
  • Receive information on the progress of the search.

3. The right to custody and guardianship:

  • If both parents of a child are missing persons under special circumstances, guardianship/custody is established over the child.
  • If the missing person was dependent on adult persons who, due to their health condition, cannot exercise their rights and obligations independently, guardianship is also established over them.
