An employee left his place of residence due to military operations. Can the employer refuse to grant him unpaid leave?

No, the employer has no right to refuse to grant such leave:

  • Duration of the leave: Such leave is granted for the period specified in the employee's application, but not more than 90 calendar days.
  • Confirmation: The employee must provide documents confirming that he/she has left Ukraine or has acquired the status of an internally displaced person.

In addition to the mandatory unpaid leave, an employee may request leave for a period exceeding the 90 days with the consent of the employer.
