Conditions for a Simplified Procedure:

  • You can establish guardianship or custodianship through a simplified procedure if:
  • You have family or kinship ties with the child (e.g., the child is your niece/nephew, grandchild, etc.).

Steps for Establishing Guardianship/Custodianship:

1. Contact the Child Services Department:

  • Submit the required documents to the child services department in your area of residence or where the child was found.

2. Required Documents:

  • Application expressing your desire to assume guardianship/custodianship.
  • Copy of your Ukrainian citizen passport.
  • Documents confirming family or kinship ties with the child.
  • Certificates from a narcologist and psychiatrist.
  • Certificate of criminal record (if obtainable).

3. Review of Documents and Home Assessment:

  • After submitting the documents:
  • A child services employee will visit your home.
  • They will assess the living conditions and prepare a report.
  • If possible, they will also communicate with the child to consider their opinion.

4. Decision by the Guardianship and Custodianship Authority:

  • If the decision is positive, the guardianship and custodianship authority will issue an order establishing guardianship/custodianship.
  • From the moment the order is issued, the guardianship or custodianship is officially recognized as established.

  • If you do not have family or kinship ties with the child, you must follow the general procedure for establishing guardianship/custodianship.
