The procedure for determining the amount of alimony in a fixed monetary amount

In Ukraine, the amount of child support can be determined as a fixed monetary amount.

  • This approach is applied when the payer of alimony has irregular or fluctuating income, receives part of their income in kind, or when there are other significant circumstances.
  • Procedure for determination:

1. Filing a claim: One of the parents or the child's legal representative files a claim in court for the collection of alimony in a fixed monetary amount.

2. Case review: The court examines the financial situation and needs of the child, as well as the financial capabilities of the alimony payer.

3. Issuing a decision: The court determines the amount of alimony in a fixed monetary amount, considering the circumstances of the case and ensuring the best interests of the child.

Important considerations:

  • Indexation: The amount of alimony determined in a fixed monetary sum is subject to indexation according to the law.
  • Minimum amount: If the determined amount of alimony is less than 50% of the minimum subsistence level for a child of the corresponding age, the child is entitled to state assistance equal to the difference between the determined amount of alimony and 50% of the minimum subsistence level.
