The procedure for uncontested divorce

Divorce by mutual consent of the spouses in Ukraine can be carried out through the state civil registry offices (DRACS) or through the court, depending on whether the couple has minor children.

1. Divorce through DRACS:

  • Conditions:
  • The spouses do not have common minor children.
  • Both spouses agree to divorce.
  • Procedure:
  • Submit a joint application for divorce to DRACS at the place of residence of one of the spouses.
  • Provide passports and the marriage certificate.
  • Pay the state fee.
  • Timeline:
  • DRACS registers the divorce after one month from the submission of the application, if it has not been withdrawn.

2. Divorce through Court:

  • Conditions:
  • The spouses have common minor children.
  • Both spouses agree to divorce.
  • Procedure:
  • Submit a joint application for divorce to the court at the place of residence of one of the spouses.
  • Attach a written agreement that specifies:
  • With which parent the children will live.
  • The involvement of the other parent in raising and supporting the children.
  • The amount of alimony for child support.
  • Pay the court fee.
  • Timeline:
  • The court considers the case and issues a decision on divorce after one month from the submission of the application, if it has not been withdrawn.

Note:

  • After the divorce, each spouse has the right to divide joint property and determine the children’s place of residence.
  • If the divorce is through the court, the marriage is terminated on the day the court decision comes into force.
  • If the divorce is through DRACS, the marriage is terminated on the day the divorce is registered by the state.
