Procedure to follow in the event of a death in a non-government-controlled area.

  1. Obtaining a document on the spot:
  • A death document issued by the authorities in the non-government controlled area has no legal force in Ukraine, but it must be obtained for further use as evidence in court.
  1. Filing an application to the court:
  • Apply to any court on the territory controlled by Ukraine with an application to establish the fact of death.
  • Indicate in the application:
  • Information about the deceased person (name, date of birth, place of residence).
  • Circumstances of death.
  • The purpose of establishing the fact of death (for example, obtaining a death certificate for inheritance).
  • Why it is impossible to issue a death certificate in the general procedure.
  1. Documents required:
  • A document issued in the uncontrolled territory (for example, a death certificate or its equivalent).
  • Documents confirming the relationship with the deceased person (birth certificate, marriage certificate, etc.).
  • Other documents that will help the court establish the circumstances of the death.
  1. Consideration of the case by the court:
  • The court considers such cases without delay.
  • The court decision may be sent to the Civil Registry Office for state registration of death.
  1. Obtaining a death certificate:
  • After receiving the court decision, contact the Civil Registry Office to obtain a death certificate.

Note:

Judicial determination of the fact of death is the only legal way to obtain a death certificate in cases where the death occurred on the non-government controlled territory of Ukraine.
