Renewal of a broken marriage in the event of the appearance of a person declared dead or recognized as missing

1. If the person was declared dead:

• If a court decision declaring a person dead is cancelled, the marriage is automatically renewed.
• Condition: Neither spouse has entered into a new marriage.
• If one of the spouses has entered into a new marriage, the previous one cannot be renewed.

2. If a person has been declared missing:

• The marriage is not automatically renewed, but can be renewed:
• Upon joint application of the spouses;
• Provided that none of them has entered into a new marriage.
