Peculiarities of care for adult children by parents

In Ukraine, parents are obligated to support their adult children under certain conditions defined by law.

1. Support for incapacitated adult children:

  • Conditions: Parents are required to support adult children if they:
  • Are incapacitated.
  • Need financial assistance.
  • Are able to provide such assistance.
  • Incapacity: Includes people with disabilities or those who have reached retirement age.
  • Financial assistance: Refers to situations where the child does not have sufficient means for living.

2. Support for adult children who continue their education:

  • Conditions: Parents are required to support adult children up to the age of 23 if they:
  • Continue their studies.
  • Need financial assistance.
  • Are able to provide such assistance.
  • Form of education: Can be full-time, part-time, or evening studies.
  • Financial assistance: Refers to situations where the child does not have sufficient means for living while studying.

3. Order of alimony collection:

  • Voluntary order: Parents can enter into a written agreement for alimony payment, which must be notarized.
  • Court order: If there is no agreement between the parents and the child, the child can file a lawsuit in court to collect alimony.

4. Amount of alimony:

  • Determining the amount: The court determines the amount of alimony, taking into account the material and family situation of the parties.
  • Form of payments: Alimony may be set as a fixed sum of money or a percentage of the parents' income.

5. Termination of the obligation to support:

  • Grounds: The obligation of parents to support adult children ends in the following cases:
  • The child regains their ability to work.
  • The child completes their education or reaches the age of 23.
  • The child obtains sufficient means for living.
