Is it necessary to pay a mortgage loan for housing located in a territory not controlled by the Government of the country?

Share

A borrower whose home is located in the uncontrolled territory has the right to apply to the lender for a suspension of payment of a monetary obligation, which includes

  • principal amount of the loan;
  • interest for using the loan;
  • commissions;
  • other payments stipulated by the agreement.

How to apply:

1. Filling in the application:

  • The application must be signed by the borrower or his/her representative. This can be done:
  • Manually.
  • Using a qualified electronic signature (QES).

2. Transfer of the application:

  • The application is submitted or sent to the lender in the original.
  • In the case of an electronic signature, electronic communication channels established by the lender may be used.

3. Additional documents:

  • It is recommended to provide documents confirming the location of the property in the uncontrolled territory (e.g. an extract from the real estate register or official certificates from the relevant authorities).

Important:

  • Suspension of payment of a monetary obligation does not exempt you from fulfilling the terms of the agreement. The debt may be repaid after the situation is resolved.
  • The specific conditions of the suspension (e.g., timeframe) depend on the bank or creditor.

It is recommended to contact the banking institution for detailed explanations that take into account your specific situation.
