Is it prohibited to travel abroad if there is a decision to collect debt on a loan / there is an open executive proceeding?

• The existence of a court decision on debt collection or an open enforcement proceeding is not in itself a ground for a ban on traveling abroad.
• However, if the debtor evades the court's decision, the court may issue a ruling on a temporary restriction on the right to travel outside Ukraine.

When is the travel ban imposed?

1. Court order:

• The court, upon a motion by a public or private enforcement officer, may restrict the debtor's right to travel outside Ukraine if:
• The debtor evades the execution of the judgment.
• There is confirmed evidence of non-compliance with the judgment.

2. Duration of the ban:

• The prohibition is valid until the obligation is fulfilled, the debt is repaid, or the court order is cancelled.

How can I find out about the ban?

• Information about the travel ban can be obtained from the bailiff's office:
• At the Enforcement Service or from the bailiff in charge of the case.
• Through the Unified Register of Debtors (available online).

Recommendations to debtors:

1. Check if there are any restrictions:

• In the register of debtors.
• The bailiff conducting the enforcement proceedings.

2. Repay the debt or agree on a restructuring.

3. If there is already an injunction, apply to the court to cancel it, provided that the obligation is fulfilled.
