Is there criminal liability for committing sex-based violence?

In Ukraine, criminal liability for sex-based violence as a separate offense is not established. However, criminal liability may apply in cases of rape and sexual violence, as defined by the Criminal Code of Ukraine: 

  • Rape (Article 152 of the Criminal Code of Ukraine) - the act of performing sexual acts involving vaginal, anal, or oral penetration into another person’s body using genitals or any object, without the voluntary consent of the survivor. 
  • Sexual violence (Article 153 of the Criminal Code of Ukraine) - the act of committing any violent sexual acts not involving penetration into another person’s body, without the voluntary consent of the survivor.
