Conditions for Establishing Guardianship/Custodianship Abroad:
1. Regulation under the Legislation of a Foreign Country:
- Guardianship or custodianship over Ukrainian citizens residing outside Ukraine is established in accordance with the laws of the country where the child resides.
2. Recognition of Guardianship/Custodianship in Ukraine:
- Guardianship or custodianship established abroad is recognized as valid in Ukraine if:
- There are no objections from the Ukrainian consular institution.
- A conclusion from the consular institution confirms the appropriateness of establishing guardianship/custodianship.
