Conditions for recognizing a marriage dissolution as fictitious:

1. A divorce carried out by the Civil Registry Office (DRACTS) may be recognized as fictitious if:

• The spouses who filed for divorce do not have children.

2. The court establishes that the husband and wife:

• Continued to live together as a family.
• Had no intention of ending their marital relationship.

Procedure for recognition:

1. The interested party, who wishes to challenge the divorce, can file a petition with the court.

2. If the court upholds the claim:

• The civil registry record of the divorce is annulled by the DRACTS.
• The divorce certificate is declared invalid.
