Does the guardian, carer has the right to go abroad?

No, as a general rule, a person liable for military service cannot travel abroad during martial law.

Travelling is permitted only in the following cases:

1. Guardianship or custody of a person with a disability

  • It is necessary to provide documents confirming the person's disability (a certificate from the Medical Service of Ukraine or another document).

2. Guardianship over an incapacitated person

  • A court decision declaring the person incapacitated must be provided.

Thus, if an elderly person needs constant care, but:

  • does not have the status of a person with a disability;
  • or is not recognised as incapacitated by a court decision, a conscripted carer is not entitled to travel abroad.
