Legal assistance helped to formalise the inheritance of a house

In August, Valentyna* from the village of Komyshuvakha sought legal assistance from Caritas Kharkiv. She was unable to independently obtain a certificate of inheritance rights under a will for a residential house because the property was located in occupied territory. The documents and archives required for the procedure were inaccessible.


Lawyer Andrii explained the procedure applicable in such cases and outlined the possible legal mechanism for obtaining a certificate of inheritance rights under a will.

During the analysis of the documents, several additional challenges became apparent:

  1. title documents confirming the deceased testator’s ownership rights were missing;
  2. the archive where such information could have been obtained was inaccessible due to occupation;
  3. information regarding the testator’s ownership rights to the residential house was absent from the State Register of Rights to Immovable Property ;
  4. the notary refused to issue the certificate of inheritance rights under a will.


Thanks to legal support, it became possible to collect the necessary documents, complete the required procedures, and register the deceased owner’s property rights in the State Register of Rights to Immovable Property .

After that, Valentyna obtained the inheritance certificate and completed the registration of the house in her name.

She now has the necessary documents to further protect her rights, including submitting a claim to the Register of Damage for Ukraine regarding destroyed housing under the established procedure.
