Establishing ownership of a house through a court in the occupied territory

Legal support helped the IDPs Liubov and Vasyl to register the ownership of their house located in a village in Donetsk region, which is currently occupied by the Russian Federation.

Liubov and Vasyl are internally displaced persons from Donetsk Oblast. After the death of their mother, they did not have time to inherit their house in the village of Berestove, Bakhmut district, and because of the fighting, they moved to the city of Nizhyn.

To resolve the issue of inheritance, they turned to the NGO “MART” for help. Lawyer Dmytro explained the procedure for filing a claim and provided a step-by-step algorithm for collecting documents for its preparation. In addition, the lawyer provided support during the trial.

In the end, the court ruled in favor of Lyubov and Vasyl and recognized their ownership of the house. In the future, this will facilitate many legal aspects, for example, they will be able to apply for compensation for damage to the house when the appropriate mechanism for the occupied territories is developed.

Free legal aid is provided by the NGO “MART” in cooperation with the Danish Refugee Council (DRC) with funding from the European Union's civil protection and humanitarian aid.
