Yulia applied to a lawyer from the Charitable Organization “Caritas Kharkiv” regarding the appointment of child support payments for her daughter, who had turned 18 and continued her studies.
With her daughter’s enrollment in a higher education institution, the family’s financial situation worsened, requiring support from the child’s father. The family also had younger children, and the mother’s income was insufficient. However, the father did not show willingness to voluntarily provide financial support for the child, which prompted Yulia to seek free legal assistance.
The lawyer filed a claim in court to recover child support for the daughter who continued her education. Unfortunately, the court of first instance dismissed the claim, citing that the father was financially unable to provide support for his daughter, based on his latest property declarations.
Disagreeing with this decision, the lawyer filed an appeal.
Upon reviewing the complaint, the court of appeal ruled that the decision of the first-instance court had been issued in violation of substantive law, as a result of which the claim was upheld.
Thus, the rights of the child who continues her education were protected, and the financial situation of the family in hardship will improve.
