Restoration of title documents for inheritance formalization
Anna* and Oleksii* contacted a lawyer of the NGO STEP regarding the formalization of inheritance due to the loss of title documents for immovable property.
In one case, the title document for the property was a lifelong maintenance agreement concluded between the deceased and his mother, who had also passed away. In the other case, the deceased’s ownership was confirmed by a gift agreement. Both agreements had been lost, and therefore the notary was unable to confirm the deceased persons’ ownership of the immovable property.
The lawyer clarified the circumstances of the conclusion of the agreements, the dates of their notarization, and the notaries who had certified them. Requests were prepared and submitted to the notarial archive to obtain duplicates of the documents.
After the deceased persons’ property documents were restored, ownership was duly confirmed. This enabled Anna and Oleksii* to apply to a notary, formalize the inheritance, and obtain certificates of inheritance rights.
Thus, thanks to comprehensive legal assistance, the heirs were able to exercise their right to inheritance and obtain the necessary title documents, ensuring the full possibility of possessing, using, and disposing of the inherited property, as well as applying for compensation in the event of its loss or damage.
