In April 2022, Ms. Hanna* and her elderly mother had to move from Donetsk Oblast to Cherkasy. Unfortunately, her mother died in the fall, and it became necessary to formalize her inheritance. However, this process was complicated by the loss of title documents for the property that remained in the war zone.
The notary, due to the lack of necessary documents, issued a decision to refuse to perform the notarial act. In search of a solution, Ms. Hanna turned to Caritas Mariupol, a charity organization supported by DRC, for legal assistance.
The Foundation's lawyer helped to collect the necessary evidence and prepared a statement of claim to the court to recognize the ownership of real estate by inheritance by law. One of the key pieces of evidence was a response from the Department of Registration Powers and Maintenance of the Territorial Community Register of the Kramatorsk City Council, which confirmed the fact of registration of ownership of the house.
The court made a positive decision, which allowed Ms. Hanna to register her ownership of the inheritance in the State Register of Real Property Rights and obtain a corresponding extract from the register.
Thanks to qualified legal assistance, which included judicial support, the ownership of the inheritance was protected. In the event of the destruction of the house, the woman will now be able to receive proper compensation.
