Recognition of ownership of real estate through the court due to the lack of data from the Bureau of Technical Inventory (BTI)

Recently, Volodymyr*, a lawyer of the Caritas Mariupol Charitable Foundation based in Dnipro, contacted the Pravovsim platform.
The man's house in the village of Orlivka, Pokrovsk district, Donetsk region, was destroyed during the hostilities. When he applied for compensation for the destroyed house, he was told that he needed to register his ownership of the house in the State Register of Real Property Rights. However, the state registrar refused to register Volodymyr's property because the BTI did not provide proof of ownership. This often happens because the BTI archives are located in the war zone or in uncontrolled territory. The only way to resolve the issue is to go to court.
Since the man currently lives in Cherkasy region, a Caritas Mariupol lawyer provided legal assistance to the displaced person remotely and helped him collect the necessary documents, preparing a lawsuit. In addition to legal assistance, Volodymyr also received financial support to pay for court costs, which was important for the progress of the case.
In October, the court upheld the claim and recognized Volodymyr's ownership, allowing him to register the house and receive compensation for the destroyed property.
Free legal aid for IDPs in Dnipropetrovska oblast became available thanks to the cooperation of Caritas Mariupol with the Danish Refugee Council with funding from the European Union.
