Mr. Volodymyr* turned to Tetyana, a lawyer of the public organization "MART", for help in registering the ownership of half of his house.
The man inherited part of the house after the death of his aunt, but could not properly register the other half, as it belonged to his relative, who died in 2006 without registering the ownership of his part of the house during his lifetime.
Volodymyr applied to a private notary to claim the right to inherit the property under the will, but received a refusal because there were no documents confirming that his aunt had the right to own this part of the house at the time of the inheritance opening.
The lawyer prepared and mailed a statement of claim with a package of documents to the court to recognize the ownership of half of the house. The court ruled in favor of the man and recognized his ownership of the part of the house.
After the decision came into force, the lawyer, together with Volodymyr, applied to the state registrar of civil status acts for state registration of ownership in accordance with the court decision. They managed to obtain the necessary extract from the State Register of Property Rights.
Now the man owns the house, which is fully owned by him in accordance with the documents, and can fully own his property and dispose of it at his own discretion.
Free legal aid in Chernihiv region is provided by the NGO "MART" in cooperation with the Danish Refugee Council (DRC) thanks to the financial support of the Humanitarian Fund for Ukraine.
