Terms and Conditions


1. GENERAL INFORMATION


These Terms of Use (the "Terms") define the procedure and rules for using the Platform (as defined below), which is administered by the Platform Operator (as defined below). The Platform Operator has the right to review these Terms from time to time, make changes and update these Terms on the Platform.


Please read these Terms carefully before accessing, authorizing or using the Platform or any part thereof. By accessing, browsing or using the Platform, you acknowledge that you have read, understood these Terms and agree to be bound by these Terms (as amended from time to time), as well as other Platform Rules (which are incorporated into these Terms by reference). We strongly recommend that you do not use the Platform if you do not agree to these Terms.


2. DEFINITION OF CONCEPTS

2.1. Authorized User – is a User who has registered an electronic cabinet and is entitled to send a Consultation Request Form through the Platform.

2.2. Authorized Lawyer – is a Lawyer who has successfully passed authorization on the Platform, as a result of which he/she received:

1.       access to the account;

2.       the right to communicate with Authorized Users through the Platform;

3.       the right to provide Consultations;

4.       the right to post their own author's publications in the Blog section free of charge, subject to the Platform Rules; 

5.       and other features provided by the Platform functionality.


2.3. Free legal aid – provision by the Authorized Lawyers of information on the law and its application practice for the Authorized Users based on humanitarian principles and human rights.


2.4. Owner of personal data – The Danish Refugee Council Mission in Ukraine is a personal data controller that processes personal data and is responsible for its protection and processing in accordance with the legislation on personal data protection.


2.5. Consultation – is the direct process of obtaining by the Authorized User of the Free Legal Aid provided by the Authorized Lawyer upon the Request Form sent by the Authorized User, by electronic means of communication or in person in the manner determined by the Authorized User and the Authorized Lawyer. 


2.6. User – is a person who needs Free Legal Aid and/or wants to get acquainted with the information posted on the Platform and is, in particular, but not exclusively (i) a citizen of Ukraine who has the status of a refugee or a person in need of temporary protection, (ii) an internally displaced person, (iii) a person from vulnerable groups (within the meaning of the Law of Ukraine "On Social Services" No. 2671-VIII of January 17, 2019).


2.7. Online chat – is a function provided by the platform for user interaction with a lawyer to exchange text messages. It is used by the user to obtain information, resolve issues, or discuss a particular topic. In the context of a legal definition, chat can be used by a lawyer to communicate with clients to exchange legal information and resolve legal issues.


2.8. Platform Operator – The Danish Refugee Council in Ukraine, identification code: 26619688, location: 17/52 Bohdana Khmelnytskoho Street, Kyiv, 010504, Ukraine.


2.9. Platform - a web-based platform by e-mail [email protected]


2.10. Rules of the Platform – all terms, conditions, disclaimers and warnings, which, in particular, but not exclusively, (i) are provided for in these Terms, (ii) are posted on the Platform by the Platform Operator, and consent to which is required when authorizing on the Platform to obtain the status of Authorized User / Authorized Lawyer.


2.11. DRC Content Selection Specialist (CSS) – Representative is a representative authorized by the Platform Operator who, on its behalf, directly interacts with the Authorized Lawyers in order to comply with the Platform Rules and has other powers provided for by these Terms.

·       Compliance and quality control specialist of the digital legal aid platform - is a specialist responsible for ensuring that the platform complies with legal requirements, standards and internal regulations. His/her responsibilities include analyzing and implementing compliance procedures, quality control of legal aid provision, audits and inspections to detect violations, collaboration with developers to make changes and improvements, and training and consulting on compliance issues for colleagues and users of the platform.


2.12. Request form - is an interactive form that is filled in by the Authorized User in his/her electronic cabinet in a chat with the Authorized Lawyer in order to receive a Consultation. This form allows users to conveniently and structuredly provide the necessary information to the Authorized Lawyer to receive legal assistance and advice on legal issues.


2.13. Lawyer – a person who has legal knowledge in the field of legal sciences, legislation and practice of its application and has completed a complete higher legal education in the meaning of the legislation of the relevant jurisdiction. For the avoidance of doubt, a lawyer under Ukrainian law is a person who has completed a complete higher legal education in the specialty of law and/or international law within the meaning of the Law of Ukraine "On Higher Education" No. 1556-VII dated December 27, 2023.


2.14. A third party providing free legal aid on a digital platform is a party that provides free legal aid to a person who needs legal support but does not have the means to pay for legal advice or legal services. This can be a non-governmental organization, human rights organization, charitable foundation, bar association or government agency that provides access to justice for civilians affected by armed conflict. The main goal of a third party providing free legal aid is to ensure equal access to justice for all, regardless of their financial situation.

3. RESPONSIBILITY

3.1. The Platform Operator shall be responsible only for the operation of the Platform and the Online Chat. 


3.2. The Platform Operator shall not be liable for:

1.      to the Authorized User for the quality, proper provision, usefulness and accuracy of the Advice;

2.    to the Authorized User and/or the User for the quality, proper provision, usefulness and accuracy of publications posted by the Authorized Lawyers on the Platform;


The Platform Operator assumes that the Consultations and other Free Legal Aid provided by the Authorized Lawyers, as experts in the field of law of their country, comply with the legislation of the respective country.


1.       for internal communication via electronic accounts of Authorized Users / accounts of Authorized Lawyers on the Platform, e-mail, Online Chat or otherwise; and

2.       for a technical malfunction of the Platform. 


3.3. Neither the Platform Operator nor the Owner shall be responsible for the storage and protection of personal data provided by the Authorized Users:

1.       through the electronic system of communication with the Authorized Lawyer (via chat with the Authorized Lawyer in the electronic cabinet of the Authorized User);

2.       via online chat; and

3.       during the Consultation. 


3.4. The Platform Operator encourages Users to refrain from providing personal data (including, but not limited to, identity documents, title documents, etc.) in ways not expressly provided for by the Platform Rules. Authorized Lawyers shall be responsible for processing such personal data.


4. OPERATION OF THE PLATFORM

4.1.The Platform provides Free Legal Aid to Authorized Users and allows Authorized Lawyers to receive Request Forms from Authorized Users for further provision of Consultations by Authorized Lawyers. 


4.2. The Platform allows Authorized Users to book Consultations for the purpose of obtaining Free Legal Aid both by electronic means of communication and in the manner determined by the Authorized User and the Authorized Lawyer. 


4.3. The Platform functions as a system for tracking Authorized Users' Request Forms for Consultations to be provided by Authorized Lawyers.


4.4. The Authorized User shall send a message to the relevant Authorized Lawyer of the respective country. The Authorized Lawyer who receives the message shall process it and contact the Authorized User in accordance with the procedure established by the Platform Rules.


4.5. Authorized Users have the right to:

4.5.1. leave a review about the Authorized Lawyer and the Consultation provided by him/her, which consists of a comment and a rating on a five-point scale;

4.5.2. interact with the Platform through the Online Chat, Questions and Answers, receive legal and other reference information through it; and

4.5.3. leave comments after articles in the Blog section of the platform.


4.6. Comments, feedback and/or other statements, interaction between Authorized Lawyers and/or representatives of the Platform Operator and/or Authorized Users shall not contain forms of disrespect for a person or public morality, obscene statements, insults that violate the honor and dignity of a person. 


4.7. The Platform Operator shall have the right to:

1.       delete a comment, review or other statement of the Authorized User and/or the Authorized Lawyer that violates clause 4.6 of these Terms;

2.       block the access of the Authorized User and/or the Authorized Lawyer to the Platform and its functions in case of systematic violation of clause 4.6 of these Terms. A systematic violation shall be deemed to be a violation committed more than once.


4.8. Authorized Users and/or Authorized Lawyers who have detected signs of violation of clause 4.6 of these Terms and Conditions shall have the right to report the detected fact by means of (i) the "Contact Us" section, (ii) Online Chat, or (iii) telephone numbers posted on the Platform.

5. INFORMATION FOR USERS OF THE PLATFORM

5.1. The Platform's FAQ section contains useful legal and other reference information organized by categories and subcategories. 

5.2. If the Users do not find an answer to their question in the "Questions and Answers" section of the Platform, they have the right to (i) write to the Online Chat or (ii) log in to the Platform to make an appointment for a Consultation with an Authorized Lawyer.

5.3. The activities of the PravoVsim digital platform cover a wide range of legal issues reflected in the humanitarian response to the aftermath of war. We strive to provide comprehensive legal assistance to civilians, internally displaced persons (IDPs), refugees and other categories of persons affected by the armed conflict, providing them with legal advice and support in solving difficult life situations.


However, it is important to note that the PravoVsim platform does not deal with criminal cases and cases related to administrative offenses. Our lawyers do not provide legal assistance to combatants - persons who participate in hostilities or perform military duties in a conflict zone. We are focused on supporting those in need of legal protection that ended wars, but our work does not include protecting the rights of combatants or persons actively participating in military operations.


It is also worth emphasizing that lawyers working on the PravoVsim platform do not have the opportunity to authorize the representation of injured persons in court, that is, they cannot act on behalf of clients during legal proceedings or participate in court sessions. However, this does not limit their ability to provide significant assistance at the stage of trial preparation. Lawyers can help use the platform in the general analysis of the case, development of the defense strategy.


In particular, the lawyers of the platform can prepare all the necessary procedural documents, such as claims, motions, appeals, applications for the provision of evidence, as well as other documents necessary for conducting the case in court. They can also develop a detailed case management plan that includes risk assessment, selection of the most effective legal tools and possible options for resolving the dispute.


In addition, lawyers provide advice on the procedure for conducting a case, clarification of procedural rights and obligations, and explain how to act at various stages of a court proceeding. This is for all users to feel confident and well-prepared to participate in court proceedings, even if they appear in court on their own. Thus, despite the fact that lawyers cannot represent clients in court, their assistance at the stage of preparation is exclusively a price and allows injured persons to effectively protect their rights and interests.


The PravoVsim platform works to maximize the resolution of legal issues reflected in the war-affected population, with special attention to the social and humanitarian aspects of legal protection.

6.AUTHORIZATION ON THE PLATFORM

6.1. The User shall have the right to register on the Platform and obtain the status of an Authorized User.


6.2 In order to obtain the status of an Authorized User, the User shall fill out an electronic form for registration of the Authorized User's account on the Platform and when filling out such form


а) provide the following information:

і. full name; and

ii. email address;

ііі. means of communication (phone number); 


b) to provide voluntary, full and unconditional consent of the User to the Platform Rules by checking the box;

с) provide the User's voluntary, full and unconditional consent to the processing of his/her personal data in accordance with the Platform Rules by ticking the box.

7.REQUEST FORM

7.1. To receive a Consultation, an Authorized User:

1.       selects the category to which the question belongs in the Find a Lawyer section or the Other section if the question does not belong to any of the categories;

2.       after selecting the category of the issue, selects an Authorized Lawyer from the proposed list; and

3.       after selecting the Authorized Lawyer, selects the time period (slot) within which the Authorized User wishes to conduct the Consultation.

7.2. After completing the steps described above, the Authorized User sends a message to the Authorized Lawyer and discloses the essence of his/her request with a detailed description of the problem or issue requiring consultation. In this message, the user may include all the necessary information and circumstances related to his/her case to ensure that the lawyer understands the situation properly and receives quality advice.

7.3. After the Authorized User clicks "Send Message", the message is sent through the Platform system to the Authorized Lawyer, and the Authorized User receives confirmation (by e-mail or in any other way provided by the Platform).

7.4. The Platform system shall make such request available to the selected Authorized Lawyer. The Authorized Lawyer who has confirmed the acceptance of the Request Form for processing shall send a response to the Authorized User in the manner provided for by the Platform functionality. 

7.5. The Authorized Lawyer shall prepare a response within a reasonable time.

7.6. If the Authorized Lawyer has not provided confirmation of acceptance of the Request Form for processing or the possibility of providing the Consultation, the Authorized User shall receive a corresponding notification (by e-mail or in any other manner provided by the Platform).

8.INFORMATION FOR LAWYERS AND THIRD PARTIES ON THE PROVISION OF FREE LEGAL AID ON A DIGITAL PLATFORM

8.1. To obtain the status of an Authorized Lawyer, a lawyer goes through the stages of registration on the platform, including providing the necessary personal data and documents confirming his or her qualifications and the right to provide legal services. Upon completion of this process, the lawyer sends a final verification request to the Platform Operator, who verifies the information provided and compliance with all requirements for obtaining the status of an Authorized Lawyer on the platform.

8.2. The Platform Operator shall have the right to set its own requirements for the qualifications, education, experience of the Lawyer, etc., in particular by sending them to such Lawyer after the latter has filled in and sent the Electronic Request for the Lawyer.

8.3. In case of non-compliance of the Lawyer with the established requirements and criteria, the Platform Operator shall have the right to refuse to authorize the Lawyer. Such refusal shall be made by sending a notification to the e-mail address specified by the Lawyer in the Lawyer's Electronic Request.

8.4. By registering on the Platform, the Authorized Legal Professional voluntarily, fully and unconditionally agrees that legal aid on the Platform is provided free of charge in accordance with the Platform Rules. 

8.5. An Authorized Legal Professional shall adhere to the core values and guiding principles of the Platform, in particular, Authorized Legal Professionals shall: 

·       not to disclose information constituting the attorney-client privilege without the consent of the User/Authorized User;

·       recognize, protect and respect fundamental human rights, enshrined, in particular, in the Universal Declaration of Human Rights of 1948, the Convention for the Protection of Human Rights and Fundamental Freedoms (European Convention on Human Rights) of 1950, including the right to:

1.       equality in dignity and rights regardless of race, color, sex, language, religion, political or other beliefs, national or social origin, property, birth or other status;

2.       social and international order; and

3.       free choice of place of residence, etc.

·       actively promote the observance of the principles, customs and norms of international law on refugees, internally displaced persons, displaced persons and asylum, international law, human rights and international humanitarian law;

·       respect the dignity of each User, promote understanding, respect, compassion and tolerance, exercise caution and maintain confidentiality where necessary;

·       show respect to Users regardless of their race, sex, gender, religion, national/ethnic, language and other affiliation, marital status, sexual orientation, age, socio-economic status, disability, political beliefs or other characteristics;

·       show respect for the culture, customs and traditions of all peoples, and take reasonable steps to avoid behaviors that are culturally inappropriate; and

·       in no case allow any manifestations of sexual violence and/or exploitation.

8.6. In case of detection of a violation of the conditions set forth in clauses 8.4-8.5 above, the Platform Operator shall have the right to restrict (temporarily or permanently, depending on the nature of the violation) the Authorized Legal Professional's access to the Platform.

8.7. Authorized Lawyers of organizations (law firms/bureaus, non-governmental organizations, etc.) are also eligible to become Authorized Lawyers in accordance with the Platform Rules. Such organizations declare that their Lawyers are authorized to provide legal advice in their jurisdiction. Such organizations bear the same responsibility for the Consultations as the Authorized Lawyers.

8.8. To obtain the status of an Authorized Lawyer, a Lawyer must fill in all the data required by the platform during registration:

·       provide the following information:

1.       full name;

2.       e-mail address;

3.       contact phone number;

4.       proof of a master's degree in law and/or a law license (e.g., a link to the bar association/registry of lawyers, a certificate of the right to practice law, etc;)

5.       direction from the proposed list of legal assistance that the Lawyer can provide;

6.       Proof of experience (e.g., a scanned copy of your work record, etc.); and

7.       LinkedIn link (optional);

8.       provide the Lawyer's voluntary, full and unconditional consent to the Platform Rules by ticking the box; and

9.       provide the Lawyer's voluntary, full and unconditional consent to the processing of his/her personal data in accordance with the Platform Rules by ticking the box. 


8.9. After verification and authorization of the Lawyer, the latter's profile is posted on the Platform. The Lawyer shall receive access to his/her account in the system and further instructions from the Platform Operator.

8.10. Authorization on the Platform gives the Authorized Legal Professional the right to:

1.       posting your profile on the Platform and gaining access to your account;

2.       free placement of author's publications in the Blog section of the Platform;

3.       Provision of Consultations; and

4.       performing other activities stipulated by the Platform Rules.

8.11. Prior to posting their own author's publication in the Blog section, the Authorized Legal Executive shall coordinate it with the Compliance and Quality Control Specialist of the digital legal aid platform.

8.12. Solely for the purpose of improving the functions and content of the Platform, as well as keeping reports and statistics on the functioning of the Platform, the Authorized Legal Professional shall fill in the form based on the results of the Consultation. In the fields of the form, the Authorized Lawyer shall indicate the information that he or she considers sufficient for the purposes specified in this Article 8.12. In each case, the Authorized Lawyer shall refrain from indicating information constituting professional secrecy and other information, the indication of which may cause harm to the Authorized Users, Users, the Platform Operator, the Owner and/or third parties.

8.13. If the Authorized Legal Professional fails to comply with the offer of the Platform Operator sent in accordance with clause 8.12 above, the latter shall have the right to deactivate the Authorized Legal Professional's account on the Platform, deprive such Authorized Legal Professional of the status of the Authorized Legal Professional and block such Legal Professional's access to the Platform's capabilities.

8.14. If the Platform Operator performs the actions specified in clause 8.13, the Lawyer shall have the right to re-authorize no earlier than 6 months after the date of deactivation of his or her account. 

8.15. The PravoVsim Digital Platform Terms of Use are designed to facilitate the work of third parties, including lawyers and attorneys, on the platform. The DRC sets the basic criteria and regulates cooperation with such partners.


Registration and access: After registering on the platform, lawyers provide access to their private account to the administrator to ensure monitoring of the quality control of the consultations provided and to collect data to implement better mechanisms for providing legal advice to beneficiaries.


After each consultation, the beneficiary automatically receives a questionnaire in which he or she can fill in information about the consultation. This questionnaire also contains questions regarding the lawyer's claims for payment for services rendered and his/her compliance with all the rules set forth in DRC policies.


Some issues of providing consultations on the platform:


The main condition for providing assistance on the PravoVsim platform is legal support for beneficiaries and assistance in resolving legal issues by all possible means within the framework of using the platform, using available out-of-court methods, such activities are free of charge.


However, given the potential complexity of the issues addressed by the beneficiaries, the situation may require mandatory representation in court and protection of the beneficiary's interests during the trial, and this issue cannot be resolved using out-of-court methods.


In this case, you can work with the beneficiary on a paid basis and under the terms and conditions you have established, but such work will be carried out outside the platform and the platform will not be related to the beneficiary's case, which is accompanied by a lawyer on a paid basis. The lawyer is obliged to inform the user that all services provided on the platform are free of charge and are exclusively of a gratuitous nature. If the conversation turns to the context of providing paid services to the user, the lawyer must point this out to the user and say the following: "At the moment, we have decided that your situation requires additional support on a paid basis, which cannot be provided within the PravoVsim platform, as all services provided on the platform are free of charge. All work on a paid basis may be outside the platform and the platform will not be related to your case, which is supported by a lawyer on a paid basis."


It should be noted that when you register on the platform, you will receive a consent form, which means that you are familiar with the rules and policies of the platform and understand the consequences for violating them.


8.16. The provision of free legal aid on the PravoVsim digital platform is governed by a number of humanitarian principles, which the platform strictly adheres to. In this regard, lawyers and third parties are prohibited from dealing with criminal cases and cases related to administrative offenses. This restriction is based on the desire to maintain a clear focus on the humanitarian aspects of legal aid aimed at supporting civilians, internally displaced persons and other victims of war.


In addition, PravoVsim lawyers do not provide legal aid to combatants - persons who are directly involved in hostilities or perform military duties in the conflict zone. The platform is aimed exclusively at providing legal support to civilians and those who need assistance in resolving complex legal issues arising from the military conflict but not related to active participation in hostilities.

9.ACTIONS OF THE PLATFORM OPERATOR TO AUTHORIZE A LAWYER

9.1. The Platform Operator receives the completed Electronic Request of the Lawyer, checks it for compliance with the established requirements and criteria in accordance with the procedure established by the Platform Rules.

9.2. In order to verify the Lawyer, namely his/her level of qualification, experience, etc., the Platform Operator shall send to the e-mail address of the Lawyer specified in the Lawyer's Electronic Request the requirements and criteria in accordance with which the verification shall be carried out.

9.3. If the Platform Operator establishes that the Lawyer meets the established requirements and criteria, the latter shall acquire the status of an Authorized Lawyer.

10.PROCESSING OF THE REQUEST FORM

10.1. When the Authorized Lawyer receives the Notification, in accordance with the procedure set forth in the Platform Rules, he/she shall process the Request Form and provide a response to the Authorized User who sent it by electronic means of communication or in any other manner determined by the Authorized User and the Authorized Lawyer.

11.NOTIFICATION

11.1. Authorized Lawyers and Authorized Users voluntarily, fully and unconditionally agree to receive notifications from the Platform to the email address provided by them. Authorized Lawyers will receive notifications about new Request Forms (Notices), while Authorized Users will receive notifications about the status of processing of the submitted Request Form (Notice).

11.2. Authorized Lawyers and Authorized Users also give their voluntary, full and unconditional consent to receive notifications from the Platform Operator to the e-mail address provided by them, which are necessary for its effective use and further development.

12.PROTECTION OF PERSONAL DATA

12.1. Before registering on the Platform and becoming an Authorized User / Authorized Lawyer, the User / Lawyer shall read the Platform Rules and, in particular, this clause 12 of the Terms and Conditions, which contains all the necessary information regarding the processing and protection of personal data in accordance with the Law of Ukraine "On Personal Data Protection" No. 2297-VI of June 1, 2010 (the "Law").

12.2. By registering on the Platform and obtaining the status of an Authorized User / Authorized Lawyer, each such Authorized User / Authorized Lawyer shall:

1.       gives its full, voluntary and unequivocal consent to the processing of its personal data by the Owner in order to ensure the Consultations in accordance with the Platform Rules and the Law;

2.       confirms that he/she has been notified of the procedure and purpose, as well as other conditions of personal data processing in accordance with Articles 6, 8, 10, 11 of the Law;

3.       confirms that he/she has sufficient legal capacity and legal capacity under the laws of the country of residence of such Authorized User/Authorized Lawyer to agree to the Platform Rules and consent to the processing of personal data on the terms and conditions set forth herein.

12.3. The Owner is authorized to process the personal data of the Authorized Users to the following extent: Full name, location address or other contact address, e-mail address and/or contact phone number.

12.4. In order to conduct the Consultation, the Authorized Lawyer will be provided with the e-mail address and contact phone number of the Authorized User for communication. The provision of other personal data depends on the decision of the Authorized User. The scope of authority of the Authorized Lawyers with respect to the personal data of the Authorized Users shall be proportional to the achievement of the purpose of processing such data. The Owner shall not be liable for the storage and protection by the Authorized Lawyer of the personal data of the Authorized User provided by the Authorized User directly to the Authorized Lawyer.

12.5. The Owner is authorized to process the personal data of the Authorized Lawyers to the extent provided: Full name, email address, contact phone number, proof of a Master's degree in law and/or a legal license (e.g., a link to the bar association/registry of lawyers, a certificate of the right to practice law, etc.), proof of experience (e.g., a scanned copy of the work record book, etc.), a referral from the proposed list of legal assistance that the Authorized Lawyer can provide, and LinkedIn (if applicable).

12.6. For the purpose of the Consultation, the Authorized User will be provided with only the e-mail address of the Authorized Lawyer for communication with him/her. Providing the Authorized User with other personal data of the Authorized Lawyer depends on the decision of the Authorized Lawyer. The Owner shall not be responsible for the safety and protection by the Authorized User of the personal data of the Authorized Lawyer provided by the Authorized Lawyer directly to the Authorized User.

12.7. The purpose of processing the personal data of Authorized Users / Authorized Lawyers by the Owner is to ensure the conduct of Consultations and the convenience of using the Platform.

12.8. The personal data of the Authorized Users / Authorized Lawyers shall be stored by the Owner only for the period of existence of the respective electronic cabinet of the Authorized User / account of the Authorized Lawyer on the Platform.

12.9. After the expiration of the storage period, the personal data of Authorized Users / Authorized Legal Professionals shall be deleted. For reporting and statistical purposes, the personal data of Authorized Users / Authorized Lawyers may be stored after the expiration of the storage period in an impersonal form.

12.10. Authorized Users and Authorized Lawyers have the following rights with respect to personal data processed in accordance with the Platform Rules, in particular, this clause 12 of the Terms:

·       for access;

·       to receive a response within 30 calendar days on whether their personal data is processed, as well as to receive the content of such personal data;

·       to be corrected;

·       to delete personal data;

·       to object to the processing of personal data;

·       to file a complaint with the relevant authorized supervisory authority;

·       to withdraw consent to the processing of personal data.


12.11. In case the Authorized User / Authorized Lawyer revokes the consent to the processing of personal data granted to the Owner within the period of personal data storage, the Platform Operator shall have the right to deactivate the electronic cabinet of such Authorized User / account of the Authorized Lawyer on the Platform and deprive such Authorized User / Authorized Lawyer of his/her status. The Authorized User / Authorized Lawyer shall have the right to re-authorize without limitation in the terms of such authorization.

13.ONLINE CHAT


13.1. The data collected by the Online Chat shall be transferred to the Online Chat Operator in order to improve the quality of the Online Chat.


13.2. The data collected through the Online Chat is stored at the Danish Refugee Council in Ukraine, but some employees who are citizens of other countries may have access to it. Therefore, such data may be transferred outside of Ukraine to countries of the European Union. 


14.COMPLIANCE AND QUALITY CONTROL SPECIALIST OF A DIGITAL LEGAL AID PLATFORM 

14.1. The compliance and quality control specialist of the digital legal aid platform has the right to:

·       to check the information content on the Platform before and after the publication of information material (including material posted in the "Questions and Answers" and "Blog" sections);

·       send official requests, letters, proposals and demands to the Authorized Lawyers;

·       to submit to the Platform Operator a request to block the accounts of the Authorized Lawyers and electronic accounts of the Authorized Users in case of violation of the Platform Rules; 

·       to preview the author's publications sent to it by the Authorized Lawyers for approval in order to verify their compliance with the laws of the country to which they relate and the Platform Rules;

·       if the author's publication sent by the Authorized Lawyer for approval to the compliance and quality control specialist of the digital legal aid platform complies with the laws of the country to which it relates and the Rules of the Platform, to grant permission for its public posting in the Blog section of the Platform or to carry out such posting directly;

·       in case of non-compliance of the author's publication sent by the Authorized Lawyer for approval to the compliance and quality control specialist of the digital legal aid platform with the laws of the country to which it relates and/or the Rules of the Platform, provide the Authorized Lawyer with requirements and suggestions for revision in the mode of editing to facilitate obtaining permission for its public posting in the Blog section of the Platform;

·       if the Authorized Lawyer refuses to make the amendments proposed by the compliance and quality control specialist of the digital legal aid platform without a reasonable cause, to apply to the Platform Operator with a request to remove the author's publication from the Blog section of the Platform or refuse to post it; and

·       other rights directly or indirectly arising from the Platform Rules.

15.INTELLECTUAL PROPERTY RIGHTS, USE OF MATERIALS

15.1. All non-property and proprietary intellectual property rights to the design solutions, layout and style of the Platform belong to the Platform Operator and are protected in accordance with the laws of Ukraine.

15.2 All copyright, moral and proprietary rights to the content of the Consultations and materials published by the Authorized Lawyers on the Platform belong to the authors (Authorized Lawyers) and are protected in accordance with the laws of Ukraine.

15.3 The respective authors (Authorized Lawyers) are responsible for the content of the Consultations and other Free Legal Aid provided within the Platform.

15.4 Copying, quoting and further distribution of materials posted on the Platform is allowed only if a link to the Platform (the page containing the material on the https://edopomoha.org/home).

15.5 Photographic materials may be used only if the logo of the Danish Refugee Council in Ukraine is preserved.


16.OTHER PROVISIONS

16.1. The assessment of the Authorized Lawyers based on the results of the Consultations provided by them is a subjective assessment of the Authorized Users, which may be clarified by the Platform Operator and/or the Compliance and Quality Control Specialist of the digital legal aid platform by sending the relevant e-mails to the Authorized Users.

16.2. The Authorized Users do not object to the Platform Operator and/or the Compliance and Quality Control Specialist of the digital legal aid platform sending e-mails to the e-mail address specified by them. In case of receiving complaints from the Authorized Users regarding the quality of the Platform, its information content, issues of compliance with the Platform Rules by the Authorized Lawyers, etc., the Compliance and Quality Control Specialist of the digital legal aid platform shall have the right to contact the Authorized Users by the means of communication specified in the Request Form in order to resolve such issues.
