Legal consequences of the appearance of a person declared dead

If a person who was declared dead appears or information about her/his whereabouts is obtained, the court at this person's place of residence or the court that made the decision to declare her/him dead, upon the application of this person or another interested person, cancels the court decision declaring a natural person as deceased.


The following are the consequences of cancelling a court decision on a person declared dead:

- Except for money and securities, the right of the person to demand the return of his property from the person who received it free of charge during the period of declaring the person dead.

- If the property of a person who was declared dead changes hands and is sold, the value of that property is returned to him.

- Loss of dependents' right to pension due to breadwinner's death.

- Remarriage, provided neither spouse is married again.
