Share

1. Conclusion of the application:

  • The application must be signed by the borrower or his/her representative:
  • In person; or
  • By electronic signature (qualified electronic signature with legal force).
  • The application must contain:
  • Information about the loan agreement.
  • Description of the damage or destruction of the property that is the subject of the mortgage or collateral.
  • A request to suspend the payment of monetary obligations (loan principal, interest, fees, etc.).

2. Submission of the application:

  • The application must be submitted to the creditor (bank or other financial institution):
  • In person at a bank branch.
  • By post (registered letter with acknowledgement of receipt).
  • Through the official electronic services of the bank, if provided.

3. Documents to be attached:

  • The application must be accompanied by supporting documents confirming the fact of damage or destruction of the property:
  • Act of the State Emergency Service (if available).
  • Extract from the Unified Register of Pre-trial Investigations.
  • Information notice to the Register of Damaged and Destroyed Property.
  • Damage assessment report (prepared by an expert or appraiser).
  • Photo and video recordings of the state of the property before and after the events.
  • Any other official documents confirming the damage/destruction.

4. Deadlines for filing:

  • It is advisable to file an application as soon as possible after the property is discovered to be damaged or destroyed to avoid misunderstandings with the creditor.

5. Consideration of the application:

  • Upon receipt of the application, the bank is obliged to review it within the established timeframe and notify the lender of its decision (usually no more than a month). If the documents provided are not sufficient, the lender may request additional information.

6. Recommendations:

  • Before submitting your application, contact your bank to clarify the requirements for documents and how to submit your application.
  • Keep all confirmations of submission and copies of the submitted documents.
