The procedure for issuing a declaration of absence

It should be noted that in Ukraine there is also a procedure for "recognition of a person as missing under special circumstances", which you can learn more about in Q&A 12 of this section. (Link)

An individual can be recognised as missing on the basis of a court decision, if there is no information about his whereabouts in the place of his permanent residence for one year.

An application to recognise an individual as missing is submitted to the court at the applicant's place of residence or at the last known place of residence (stay) of the individual whose whereabouts are unknown, or at the location of his property.

The application to recognise an individual as missing must state:

- for what purpose does the applicant need to recognise an individual as missing;

- circumstances confirming the unknown absence of the individual.
