Temporary protection allows you to work without the need for a separate work permit while it is in effect.


Individuals granted temporary protection have the right to work under contract as well as independently.


If you are a hired worker in Spain, you have the right to: 

- have a written contract (employment contracts can be written or oral (some types are required by law to be written)). Any contract for a full-time or part-time job can be signed (except for a training contract). It can be concluded for an indefinite period of time (so-called "unlimited contracts") or for a specific period of time (so-called "limited contracts") (so-called "temporary contracts"). If the contract does not expressly state otherwise, it is assumed to be an unlimited contract with a full-time job);

- be registered with the social security and social protection service; 

- be paid not less than the minimum inter-professional salary (SMI) (if working hours are less than 40 hours per week, the salary is calculated proportionally to the actual working time); 

- be compensated or remunerated for overtime work; 

- not be discriminated against in access to work, working conditions, or professional development and promotion;

- have economic benefits for illness or accidents, risk during pregnancy, maternity, or unemployment; 

- have paid vacations of at least 30 calendar days per year and a weekly rest period of one and a half days every 14 days.

- paid leave for: 

a) marriage: 15 calendar days; 
b) childbirth, adoption, or foster care: 16 weeks; 
c) breastfeeding: 9 months (in total);
d) Death, accident, or serious illness of a second-degree relative: 2 days, 4 days if moving;
e) Moving from the place of residence: 1 day;
f) Performing an unjustified social-personal duty within the required time frame (for example, in case of being called to court).

- reducing the working day for direct care of a child under the age of 12 or a disabled person;

- demanding changes to the working day's distribution in order to effectively combine personal, family, and work life;

- demanding that your employment contract be terminated if you are subjected to persecution, mobbing, repeated delays and/or non-payment of wages, or other labor violations, with the right to compensation.


Important! 

It is not permitted to work more than 9 hours per day, and employees under the age of 18 are not permitted to work more than 8 hours per day.
