Cancellation of the court's decision to declare a person missing

If a person who was recognised as missing appears, or if information about his whereabouts is received, the court at the location of his whereabouts, or the court that decided to recognise this person as missing, cancels the decision on recognition of a natural person as missing at the request of this person or another interested person.


The annulment of a court's decision to declare a person missing is grounds for ending the circumstances that resulted from declaring a person missing:

- termination of guardianship over a person's property. 

- renewal of marriage at the request of two people in the absence of a new marriage concluded during the missing person's stay.

- Loss of dependents' right to a pension.

- the facts that occurred prior to the annulment of the court decision on missing person recognition are considered valid and are not annulled.
