Registration of a public organization and a charity Fund. What are the limitations?

The procedure of registration of public organization or a charity Fund consists of following steps

1. Preparation of statutory documents (charter).

2. Carrying out constituent meeting. 

3. Preparation of the documents (application form, information about governing bodies, charter, protocol of constituent meeting with the register of participants and application for inclusion to Register of non-profit institutions and organizations (if desired).

4. Submission of the documents to TSNAP (Administrative Service Centres).

5. Registration or refusal to register.  


Important notice!

Currently it is not possible to register public organization or a charity Fund in all regions. The list of regions, where is impossible to carry out registration, is prescribed by the Ministry of Justice of Ukraine (list).


Furthermore, during martial law certain specialties on registration has been established: 

- Registration is carried out regardless of location of public organization or a charity Fund.

- Registration is carried out immediately (in case of submission of incomplete package of documents, such following applications will not be considered and being returned to the applicant with oral notification on complete package of documents to be submitted).

- The possibility to carry out registration in electronic form. Meanwhile, electronic copies of the documents shall be signed with usage of qualified electronic signature of an applicant. 

- The administrative fee is not collected in case of registration of organization, whose main activity is providing support to Armed Forces of Ukraine, other military units, law enforcement, civil protection bodies, volunteer formations and other persons, that are ensuring national security and persons suffering or could be suffering from military aggression.
