The general procedure for establishing guardianship/custodianship during martial law

Share

General Provisions:

  • Guardianship or custodianship can be established through the general procedure, even during martial law.
  • The procedure involves submitting a package of documents and undergoing verification by the child services department.

Steps for Establishing Guardianship/Custodianship:

1. Reach out to the child services department at your place of residence with the required documents.

2. Submit Required Documents:

  • Application (joint application is required from married couples, signed by both).
  • Income certificate for the last 6 months or a copy of the income declaration, certified by the tax authority.
  • Document proving ownership or use of housing (rental agreement, property certificate).
  • Copy of marriage certificate (for married applicants).
  • Certificate of completion of child upbringing training for orphans or children deprived of parental care.
  • Copy of the applicant's passport.
  • Health certificate of the applicant.
  • Certificate from a narcologist and psychiatrist for individuals living with the applicant.
  • Criminal record certificate for each applicant.
  • Written consent of all adult family members residing with the applicant, notarized or signed in the presence of the authorized official receiving the documents.

3. Living Conditions Assessment:

  • After submitting the documents, a child services worker will:
  • Visit your home.
  • Assess the living conditions and prepare a relevant report.
  • Interview the child (if possible) to take their opinion into account.

4. Decision by the Guardianship and Custodianship Authority:

  • If the decision is positive, the authority issues an order to establish guardianship or custodianship.
  • From the moment the order is issued, the guardianship or custodianship is officially recognized.

Additional Remarks:

  • The conditions of martial law may affect the speed of processing the application due to complications in the functioning of state bodies.
  • If you have any questions regarding the requirements or the process, it is recommended to contact your local child services department.
