Are military personnel released from the obligation to pay child support?

In Ukraine, military personnel are not exempt from the obligation to pay child support. The obligation of parents to support their children until they reach adulthood is provided for in the legislation and applies to all citizens, regardless of their status or profession.

Key features of alimony enforcement for military personnel:

1. Types of income from which alimony is withheld:

  • Alimony is deducted from all types of military pay, including:
  • Base salary.
  • Rank-based salary.
  • Seniority bonuses.
  • Additional types of pay (bonuses, allowances).
  • One-time additional rewards, including "combat pay."
  • The only exceptions are payments that are not regular in nature.

2. Amount of alimony:

  • The amount of alimony is determined either by the court or by mutual agreement between the parents.
  • The law establishes a minimum guaranteed amount for alimony, which cannot be lower than 50% of the subsistence minimum for a child of the appropriate age.

3. Enforcement:

  • If alimony is not paid voluntarily, it can be enforced through the executive service.
  • If the military personnel is mobilized, the enforcement documents are sent to the respective military unit or the Ministry of Defence of Ukraine to ensure that the alimony is deducted from the military pay.
