Parents may be exempted from the obligation to support their child under the following conditions:

1. High income of the child:

  • The child’s income significantly exceeds the income of each parent.
  • This income fully meets the child’s needs.

2. Court decision:

  • Exemption from the obligation to support the child can only be granted by a court decision.
  • The court evaluates the financial situation of the child and parents, as well as other circumstances of the case.
  • Who files the application:
  • One or both parents who wish to be exempted from the obligation to support the child.
  • Required documents:
  1. Statement of claim – which outlines the grounds for the exemption.
  2. Certificates of the child’s income – proof of the child’s income (salary, scholarship, entrepreneurial activity).
  3. Certificates of the parents’ income – to confirm their financial situation.
  4. Documents confirming the expenses for supporting the child – receipts, invoices, contracts.
  5. A copy of the child’s birth certificate.
  6. A copy of the plaintiff’s passport and identification code.
