Can an employee with irregular working hours refuse to perform work at the request of the employer?

An employee who works under an employment contract with non-fixed working hours has the right to refuse to perform work in the following cases:

  • The employer requires work outside the basic days and hours specified in the employment contract.
  • The employer has notified you of the availability of work in violation of the minimum terms set out in the contract.

Refusal to perform work during the basic days and hours without good reason may be grounds for disciplinary action.
