Can an employee with non-fixed working hours demand an employment contract for full-time work from the employer?

Yes, an employee who has been working under an employment contract with non-fixed working hours for more than 12 months may demand that the employer conclude a full-time employment contract.

Conditions and procedure:

1) Application to the employer:

  • The employee submits a written request to conclude a fixed-term or indefinite employment contract on a full-time basis.

2) Employer's response: Within 15 calendar days of the request, the employer is obliged to:

  • Enter into an appropriate employment agreement with the employee; or
  • Provide a written reasoned refusal.

3) Repeated application: In the event of a refusal, the employee has the right to re-apply with such a request, but not earlier than 90 days from the date of receipt of the response to the previous request.
