Can a pet be a source of increased danger?

General rule:

  • Pets are generally not considered to be a source of increased danger because they are under the control of the owner and do not pose a significant threat to others.

Exceptions:

  • Animals that may be recognized as a source of increased danger include:
  • Service dogs (during the performance of official duties).
  • Dogs of fighting and potentially dangerous breeds, for example:
  • Sheepdog.
  • Doberman.
  • Rottweiler.
  • Cane Corso.
  • The list of potentially hazardous breed may be defined by separate regulations or decisions of local authorities.

Responsibility of the owner:

  • If a pet that is a source of increased danger causes damage:
  • The civil liability of the owner provides for compensation for material and moral damage.
  • In case of gross violation of the rules of maintenance, administrative or criminal liability may arise.
