Assistance in confirming ownership of an inherited house in court

After her husband’s death, Inna remained living in the family house in the village of Kamianske, Vasylivka district, Zaporizhzhia region, but was unable to formalise the inheritance because of the war. During the hostilities and occupation, the BTI archives became inaccessible, and some of the documents were lost. The woman did not know how to confirm her right to the property.


She applied for free legal aid to the NGO “STEP.” The lawyer helped her understand the situation and reopen the inheritance case. However, the notary whom the woman later approached refused to issue a certificate because there was no information in the State Register of Property Rights to Immovable Property, it was impossible to obtain information from the BTI, and there were also difficulties with the formalisation of the land plot.


To resolve the situation, a lawyer from NGO “STEP” prepared a claim to the court, which, following consideration of the case, recognised Inna’s ownership of the house by way of inheritance. After that, the lawyer organised the further registration actions, brought the case to the stage of entering the ownership right into the State Register, and provided support in the process of obtaining the extract.


Now the woman can make use of the available compensation mechanisms.
