In September 2023, Ms. Oksana*, an IDP and mother of two children, turned to the lawyer of the Cherkasy Human Rights Center, a DRC partner organization. In August 2023, her daughter and son stopped receiving state payments for IDPs.
During the consultation with Oksana, it was found out that payments to her and her children were suspended due to the woman's stay abroad for more than 30 consecutive calendar days, which is a violation of the requirements of the Procedure for Providing Accommodation Assistance to Internally Displaced Persons, approved by the Resolution of the Cabinet of Ministers of Ukraine of March 20, 2022, No. 332 (as amended by the Resolution of the Cabinet of Ministers of Ukraine of July 11, 2023, No. 709).
Yes, the woman had indeed been abroad for more than 30 calendar days, but her children had not traveled abroad, so the termination of payments to them was unjustified.
The lawyers prepared a corresponding appeal to the Department of Social Policy of the Cherkasy City Council, after which state aid for Oksana's children was paid in full.
Receipt of free legal aid by IDPs in Cherkasy region became possible due to the cooperation of the Cherkasy Human Rights Center with the Danish Refugee Council and funding from the European Union's humanitarian aid.
The name has been changed.
